§ 8. Mixed residential-nonresidential use regulations on same property.

(1)

In a single story structure, 100 percent of the structure shall be occupied for nonresidential use(s) only. In a multi-story structure, 100 percent of the first story of the structure shall be used for nonresidential use(s). The remaining portion of the structure above the first story may be used for either residential or nonresidential uses, or a combination of both.

(2)

Drive-through features for the transaction of business on any building shall not be permitted.

(3)

Certificates of occupancy shall be required for all structures or units, for both residential and nonresidential uses and upon any change in ownership, tenant, use, or occupancy.
