§ 5-93. Notice to repair, demolish, or remove.

  • Whenever the building official of the city shall find any building or other structure, or any portion thereof, to be a substandard building, as defined herein, the building official shall cause to be served upon the owner or other person responsible for or in charge of such premises, a written notice by certified mail, return receipt requested, demanding that such person repair, demolish, or remove the substandard building or structure or such portion thereof as necessary to remedy such condition. The purpose for such remedial actions shall be to bring such building to the standards prescribed by this article and all applicable ordinances of the city in effect at the time of such repair.

    The notice shall contain:

    (1)

    The street address and legal description sufficient for identification of the premises upon which the building is located;

    (2)

    A statement that the building official has found the building to be substandard with a brief and concise description of the conditions found to render the building substandard under the provisions of this article;

    (3)

    Schedules and deadlines for obtaining building permits and/or demolition permits;

    (4)

    Provisions for an administrative appeal of the building official's notice to the director of public works; and

    (5)

    Provisions for the city to request a judicial review by a municipal court of record to consider demolition, should the owner or occupant fail to comply with the notice given to remedy the condition, or should the building official determine demolition of the substandard building is necessary.
